Your use of the services within this Sendabubble website (services) and all the content that appears on this Sendabubble
website (the content) be it text, graphics or anything else uploaded or downloaded is governed Terms of Service (terms).
By accessing or using the Services you agree to be bound by these Terms.
Basic Terms
You are responsible for your use of the services, for any content you post to the services, and for any consequences thereof.
The content you submit, post, or display will be able to be viewed by other users of the services.
You should only provide content that you are comfortable sharing with others under these terms.
When using the services you must only do so in compliance with the above terms and all applicable local, state, national,
and international laws, rules and regulations. The services that are provided by Sendabubble may change from time to time or stop without prior notice
to you, and prior notice may not be given. Sendabubble also retain the right to create limits on use and storage, again without prior notice to you.
The data stored by Sendabubble may be removed at any time without prior notice of reason.
Sendabubble may from time to time contact you by email with announcements. You may not be able to opt out from these notifications.
You and your data may be removed from Sendabubble after a period of inactivity with prior notification on the provided email address.
It is your responsibility to access your account or data within 30 days to stop the removal, but this will not be guaranteed.
Privacy
Sendabubble will endeavour to keep all personal information private. Sendabubble will also endeavour to keep all bubbles in your private areas only accessible to
members that you have allowed to join the area. In using these services you understand that your data may be transferred around the world for storage,
processing and use by Sendabubble. You are responsible for keeping your password private, and Sendabubble take no responsibility of the consequences if you fail to
do this.
Responsibility for content and availability
The person who originated content, whether publicly posted or privately transmitted, is solely responsible for it.
Sendabubble may not monitor or control the content posted via the services and, Sendabubble cannot take responsibility for it.
Any use or reliance on any content posted via the services or obtained by you through the services is at your own risk.
Sendabubble do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any content posted via
the services or endorse any opinions expressed via the services.
You understand that by using the services, you may be exposed to content that might be offensive, harmful, inaccurate or otherwise inappropriate,
or in some cases, postings that have been mislabelled or are otherwise deceptive. Under no circumstances will Sendabubble be liable in any way for any content,
including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content
posted, emailed, transmitted or otherwise made available via the services or broadcast elsewhere.
Sendabubble do not accept any responsibility for the usability, timeliness or availability of its services although it will endeavour to maintain these to a
reasonable level.
Rights
Although you keep your rights to any content submitted to Sendabubble, you grant Sendabubble a worldwide, non-exclusive,
royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish,
transmit, display and distribute such content. No compensation will be paid to you with respect to the content that you submit, and Sendabubble
retain the right to modify the content where necessary. Sendabubble will not be responsible or liable for any use of your content in accordance with these terms.
You are granted a personal, worldwide, non-exclusive and non-assignable licence for the use of the Sendabubble software for the purpose of enabling you to participate in the
sharing of content with others in the manner permitted by these terms.
All rights to style and function of the Sendabubble software will remain solely the property of Sendabubble. The services, logos, domain names and other distinctive
brand features etc. are protected by copyright and other laws of both the United Kingdom and other foreign countries.
Restrictions on the use of the Sendabubble services
You are not allowed to tamper with any private areas of Sendabubble or to probe, scan, or test the vulnerability of any of the computer systems used by Sendabubble.
Crawling is only permissible if done in accordance with the provisions of the robots.txt file. you are not allowed to forge any part of the TCP/IP packet header in
any email to or from the Sendabubble website. You are not allowed to interfere with the freedom of others to use the services of Sendabubble by any means,
including by sending a virus, overloading, flooding, spamming, mail-bombing the services, or by scripting the creation of content in such a
manner as to interfere with or create an undue burden on the services.
Limitation of Liability
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SENDABUBBLE AND ITS EMPLOYEES WILL NOT BE LIABLE FOR ANY DIRECT,
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE,
GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES, OR
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL
CONDUCT OF OTHER USERS OR THIRD PARTIES, OR ANY CONTENT OBTAINED FROM THE SERVICES; AND UNAUTHORIZED ACCESS, USE OR ALTERATION
OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER
OR NOT SENDABUBBLE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED
OF ITS ESSENTIAL PURPOSE.
Controlling Law and Jurisdiction
These Terms and any action related thereto will be governed by the laws of the Great Britain without regard to or application
of its conflict of law provisions or your state or country of residence. All claims, legal proceedings or litigation arising in connection
with the services will be brought solely in Great Britain, and you consent to the jurisdiction of and venue in such
courts and waive any objection as to inconvenient forum. If you are accepting these Terms on behalf of a United Kingdom government
entity that is legally unable to accept the controlling law, jurisdiction or venue clauses above, then those clauses do not apply to you but
instead these terms and any action related thereto will be will be governed by the laws of Great Britain (without reference to
conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the Great Britain (excluding choice of law).
